Affiliate Program Terms
These terms govern your participation in the Empire Experience affiliate program operated by eProducts Empire LLC ("Company," "we," "us").
1. Commission
Approved affiliates earn a fifty percent (50%) commission on the net amount collected by Company for every Rich Off Travel AI membership renewal made by a customer they refer, for as long as that customer remains subscribed. "Net" means the amount after refunds, chargebacks, processor fees, and taxes. Commission rates and product eligibility may change on 30 days' notice.
2. Attribution & Cookie Window
Referrals are attributed on a lifetime (10-year), first-click basis using a cookie set when a visitor clicks a valid affiliate link. Once a visitor is credited to an affiliate, later clicks on other affiliate links do not override that attribution. Self-referrals are prohibited. Company's records are the sole authority for attribution decisions.
3. Holding Period & Clawbacks
Commissions become available 30 days after the underlying invoice is paid. Commissions on invoices that are refunded, disputed, charged back, or otherwise reversed within any period will be voided or clawed back from your balance, including from future commissions.
4. Payouts
Payouts run automatically every Friday via Stripe Connect Express, provided your available balance is at least USD $50. Amounts below the threshold roll to the next Friday. You must complete Stripe's onboarding (identity, bank/debit-card, tax information) before any payout can be issued. Company is not liable for delays caused by Stripe, your bank, or your financial institution, and reserves the right to withhold a payout that would put Company's platform balance negative until funds are available.
5. Taxes & 1099s
You are solely responsible for all taxes on commissions. For U.S. affiliates earning $600 or more per calendar year, Stripe (as our payout processor) will issue a Form 1099-NEC. You represent that all tax information you provide is accurate.
6. Promotional Conduct
You will comply with all applicable laws including the FTC Endorsement Guides, CAN-SPAM, GDPR, and consumer protection laws. You will clearly disclose your affiliate relationship. You will not: send unsolicited email or SMS; run paid ads bidding on our trademarks or domains; make earnings, income, medical, or outcome guarantees; imply endorsement by any third party; use bots, incentivized clicks, cookie stuffing, or any deceptive tactic. Violations void commissions and may terminate your account.
7. Intellectual Property
You receive a limited, non-exclusive, non-transferable license to use approved Empire Experience marks and materials solely to promote the products during your active enrollment. All goodwill belongs to Company. The license terminates automatically on suspension or program exit.
8. Termination
Either party may terminate at any time for any reason. Company may pause or terminate your account and forfeit unpaid commissions on evidence of fraud, refund abuse, or breach of these terms. Sections 3, 5, 6, 9, 10, and 11 survive termination.
9. No Employment
You are an independent contractor. Nothing here creates an employment, partnership, agency, or joint-venture relationship. You have no authority to bind Company.
10. Disclaimers & Liability
The program is provided "as is." Company's aggregate liability under these terms will not exceed the total commissions paid to you in the six months preceding the claim. Company disclaims all indirect, incidental, special, consequential, and punitive damages to the maximum extent permitted by law.
11. Governing Law & Disputes
These terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-laws rules. Any dispute will be resolved by final and binding individual arbitration in Miami-Dade County, Florida, under the AAA Commercial Rules. You waive any right to a jury trial and to participate in a class action.
12. Changes
We may update these terms; the current version is shown at the top. Continued participation after posting constitutes acceptance.
