Brand Listing Terms

A paid listing is a 90-day placement of your offer on our members-only creator offer board. The fee is $99 USD, one time, per listing. You are buying placement and exposure to our member audience — nothing else. You are not buying a specific number of impressions, claims, applications, bookings, posts, followers, revenue, or any other result, and we make no representation or warranty that any of those will occur.

Listing fees are non-refundable in all circumstances. Because a listing is a digital placement that is delivered immediately on payment, you waive any right to cancel or reverse the charge once the listing is created. This includes, without limitation, cases where:

• no creator claims or contacts you;
• you change your mind, pause your listing, or delete it early;
• your offer sells out, is withdrawn, or your business closes or changes hands;
• you supplied incorrect copy, dates, links, or contact details;
• your listing is held, edited, unpublished, rejected, or removed for breaching these terms or our acceptable use policy.

We do not issue partial refunds, pro-rated credits, extensions in lieu of refunds, or transfers of a fee to another listing or account. Initiating a chargeback for a delivered listing is a breach of these terms; we will contest it with this policy and your recorded acceptance of it, and we may permanently refuse future listings from you.

Empire Experience publishes your listing. You fulfil it. Any comp, discount, rate, commission, gifting arrangement, booking, stay, flight, charter, meal, experience, or product exchanged between you and a creator is a direct agreement between you and that creator. We are not a party to it, not an agent, broker, employer, representative, or fiduciary of either side, and we do not process, hold, guarantee, or escrow any payment between you and a creator.

We do not verify creator follower counts, engagement, audience quality, identity, eligibility, tax status, or whether a creator will deliver what they promise. Vetting creators, contracting with them, and complying with the law in your dealings is entirely your responsibility.

By submitting a listing you represent and warrant that:

• you are at least 18 and are authorised to act for the business named in the listing and to make the offer described;
• every statement, price, term, date, and restriction in your listing is accurate and current;
• you own or are licensed to use all names, logos, photos, and other content you submit, and our publication of it will not infringe anyone's rights;
• the offer and your business comply with all applicable laws, licences, and platform disclosure rules in every jurisdiction where it operates;
• the offer is not a scam, MLM, recruitment scheme, investment, or income opportunity;
• you will honour the offer as written for its stated availability, or withdraw it promptly.

We do not publish listings involving adult or sexual services, escorting, illegal activity, drugs or regulated substances, weapons, gambling, financial or income guarantees, cryptocurrency or investment promotion, MLM or recruitment, counterfeit goods, unlicensed medical or immigration services, or anything that asks creators to conceal a paid relationship from their audience. Requiring undisclosed advertising is a breach of these terms.

Listings are screened automatically on submission and publish once payment clears. A listing flagged by that screening is held and reviewed before it becomes visible to members. We may, at our sole discretion and without refund, edit a listing for length, formatting, or clarity; hold, unpublish, reject, or delete a listing; remove it in response to member reports, rights-holder complaints, or legal demands; and decline to accept future listings from you. Removal for cause does not entitle you to a refund or a replacement listing.

You grant Empire Experience a worldwide, royalty-free, non-exclusive licence to host, reproduce, adapt for formatting, display, and promote your listing content — including your brand name, logo, and images — on our site, in our emails and newsletters, and in social or marketing material referencing the offer board, for the duration of the listing and afterwards in archival or promotional contexts. You may revoke this licence for future promotion by asking us to remove the listing; that removal does not trigger a refund.

All actual travel and product transactions — stays, flights, charters, meals, tours, rentals, shipping — happen on your own platform or through your own systems, under your terms and your cancellation and refund policy. Empire Experience does not sell, book, process, insure, or refund any of them, and cannot access those transactions. Any payment, change, cancellation, chargeback, or refund question about a booking must be handled between you and the creator or customer directly.

You will indemnify, defend, and hold harmless Empire Experience, its owners, officers, contractors, and affiliates from and against any claim, demand, investigation, loss, liability, damage, penalty, fee, or cost (including reasonable legal fees) arising out of or relating to your listing, your offer, your dealings with any creator or customer, your content, your breach of these terms or of any law, or any tax, consumer-protection, advertising-disclosure, licensing, health, safety, or data-protection obligation of your business.

The offer board is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, or results. We do not warrant that the board will be free of downtime, errors, or unlawful third-party conduct.

To the maximum extent permitted by law, Empire Experience will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost bookings, lost data, lost goodwill, or business interruption, even if advised of the possibility. Our total aggregate liability arising out of or relating to a listing, on any theory of liability, will not exceed the listing fee you actually paid for that listing ($99 USD).

When a member claims your offer we may share the fact of that claim with you, and we make the contact route you provided available to members who claim it. Any personal data you receive from a creator is yours to handle lawfully as an independent controller; you must not add creators to marketing lists without their consent, resell their details, or use them for anything other than the offer. We may update these terms; the version in force for a listing is the version you accepted at submission, and a new version applies to listings submitted after it is published. A listing expires automatically 90 days after payment unless renewed as a new paid listing. These terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules, and any dispute will be brought exclusively in the state or federal courts located in Leon County, Florida. Each party waives any right to a jury trial and to participate in a class or representative action. If any provision is unenforceable, the rest remains in force.
